Welcome to Cosplai! These Terms of Service ("Terms") govern your use of the Cosplai mobile application ("App") provided by Cosplai ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Cosplai, you confirm that you:

  • Are at least 13 years of age (or the minimum age in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Accept and agree to be bound by these Terms

If you do not agree to these Terms, do not use the App.

2. Description of Service

Cosplai is a cosplay planning and social tool that allows users to:

  • Create and manage cosplay projects with budgets, deadlines, and task lists
  • Upload reference images for costume planning
  • Discover and track conventions and events
  • Use AI-powered event discovery to find nearby conventions (Pro subscribers)
  • Connect with friends and share progress on cosplay builds
  • Submit events and resources to the community

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the Service or other users

You may delete your account at any time through the Settings page. Account deletion is scheduled for 30 days in the future, during which you may cancel the deletion.

4. Subscriptions and Payments

4.1 Subscription Tiers

Cosplai offers the following subscription options:

  • Free: Up to 10 projects, 25 images per project, 3 active events, cloud sync
  • Pro ($9.99/month or $59.99/year): Unlimited projects, unlimited images, unlimited events, unlimited custom categories, AI-powered event discovery, priority support

Both plans include a 7-day free trial.

4.2 AI-Powered Features

The Discover Events feature uses AI technology (provided by Perplexity AI) to find conventions and events near you. By using this feature, you acknowledge that:

  • Event information is sourced from publicly available data and may not be accurate or up to date
  • Dates, venues, and other event details should be independently verified before making plans
  • The feature is limited to 5 searches per week per account
  • Results are shared across users in the same region and may vary based on available data

4.3 Payment Processing

  • Mobile payments are processed through Apple App Store or Google Play
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Refunds are handled according to the respective app store's policies

4.4 Price Changes

We reserve the right to change prices with 30 days notice. Price changes do not affect current billing cycles.

5. User Content

5.1 Your Content

You retain ownership of all content you upload ("User Content"), including:

  • Profile photos and avatars
  • Reference images
  • Completed cosplay photos
  • Project data and notes

By uploading content, you grant us a limited license to:

  • Store and display your content to you
  • Display your public profile and shared content to your friends
  • Create backups for data recovery

5.2 Content Restrictions

You agree NOT to upload content that:

  • You do not have the right to use
  • Contains illegal material
  • Depicts minors inappropriately
  • Violates any third party's rights
  • Contains malware or harmful code

5.3 Community Submissions

You may submit events and resources for inclusion in the community section. By submitting content, you acknowledge that:

  • Submissions are reviewed by our team before publication
  • We may edit, reject, or remove submissions at our discretion
  • Published submissions are visible to all users
  • You retain ownership of submitted content but grant us a license to display it within the App

6. Intellectual Property

6.1 Our Property

Cosplai, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or decompile the App
  • Use our trademarks without permission

6.2 Third-Party Content

Reference images you upload may be subject to third-party copyrights. You are responsible for ensuring you have the right to use any reference images for personal planning purposes.

6.3 Character and Franchise Rights

Cosplai does not provide character images or costumes. Users upload their own reference images. We are not affiliated with any anime, game, comic, or entertainment franchise.

6.4 Data Retention for Inactive Accounts

Free tier accounts that remain inactive for more than 1 year may have media files (images, photos) removed from cloud storage. Text-based project data (project names, tasks, notes, budgets) and social connections are preserved. Users receive advance email notifications at 90, 30, and 7 days before any media removal. Logging in or upgrading to Pro resets the inactivity timer.

7. Acceptable Use

You agree to use Cosplai only for lawful purposes and in accordance with these Terms. You will NOT:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm other users
  • Send unwanted or spam friend requests
  • Submit false or misleading community content
  • Attempt to gain unauthorized access or bypass rate limits
  • Interfere with the App's operation
  • Use automated systems to access the Service
  • Share your account credentials

8. Privacy

Your use of Cosplai is also governed by our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers

9.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OF CONTENT OR AI-GENERATED EVENT INFORMATION

9.2 Service Availability

We do not guarantee uninterrupted access to the Service. Downtime may occur for maintenance, updates, or circumstances beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of data, profits, or goodwill
  • Service interruptions
  • Third-party actions

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Cosplai and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

12.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that:

  • Either party may seek injunctive relief in court
  • Small claims court actions are permitted

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through:

  • In-app notifications
  • Email (if you have provided one)

Continued use after changes constitutes acceptance of the new Terms.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cosplai.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

14.3 No Waiver

Our failure to enforce any right does not waive that right.

14.4 Assignment

You may not assign these Terms. We may assign our rights to any successor.
